Amended Municipal Corporations Act, BBMP Act empower BBMP Chief

Bengaluru: On Tuesday November 17, the State Government has issued an ordinance amending the Karnataka Municipal Corporations Act, 1976, and the Bruhat Bengaluru Mahanagara Palike Act, 2020 to give the civic body’s Chief Commissioner more power.

The amendment permits the BBMP Chief to grant or deny permission for the execution of works as well as a site plan of the land, ground plan, elevations, and section of the building, subject to the zoning regulations or building bylaws’ restrictions.

According to the sources, it also allows the municipal agency to charge and levy fees for issuance of licences, security of the building, maintenance of public roads or storing construction materials in public places during construction, ground rent, occupancy certificate, and a penalty for not obtaining a commencement certificate at the start of the construction.

The amendment has come as a result of a Karnataka High Court ruling that the BBMP bylaws collecting licence fees, ground rent fees, security fees, and charges from landowners are in violation of the Municipal Act. According to officials, the BBMP has not been approving plans or charging fees since the August judgement, resulting in huge losses for the civic body.

“All acts, proceedings or things done or any action taken by the government or the BBMP officers as the case may be in connection with the levy, assessment or collection of any amount as fee for all purposes be deemed to be and to have always been made, done or taken in accordance with law. No suit or other proceedings shall be maintained or continued in any Court or Tribunal or before any authority for the refund of any such fee and no Court shall enforce any decree or order directing the refund of any such fee,” read the notification, which was issued after Governor Thaawar Chand Gehlot’s confirmation.
