Bengaluru: The State Government notified the High Court on Wednesday January 18 that it had made it clear to the BBMP and BDA that the EWS Housing Project at Ejipura should be treated as a single entity and there can be no modified development plan.
The matter has been sent to a division bench under the direction of Chief Justice Prasanna B. Varale for further consideration on February 6.
The Karnataka EWS 1512 Residential Social Welfare Association, Bengaluru, has filed a fresh PIL with the court, stating that Maverick Holdings Ltd. has delayed the completion of the project’s work.
According to the affidavit submitted by the State Government, a meeting was held on January 6 under the chairmanship of the Additional Chief Secretary, to review the letter that the BBMP had sent, seeking a response about a modified development plan for the project. The State Government claimed that on January 12, it issued a communication to the BBMP and BDA clarifying that there are no specific regulations for mixed development plans and that the entire area must be regarded as a single entity. It also stated that Maverick Holdings Ltd. could not obtain any of the unused residual Floor Area Ratio (FAR).
The affidavit also mentioned that the BBMP and BDA should both consider whether to sanction the plan in accordance with current regulations and that they must do so under the Act and zonal regulations.
Even after several orders from the High Court, the petitioners claimed that the project proponent had not finished the work. Several members of the EWS paid Rs. 30,000 each in 1995 and were still waiting for the construction to be completed. It was alleged that the temporary buildings, which were built in a faraway place, lacked the basic necessities.
