HC directs SEC to declare elections for 198 BBMP wards in 6 weeks

hc bbmp 04122020Bengaluru: The state High Court on Friday, December 4, directed the state election commission to declare elections for 198 wards of the BBMP within six weeks from the date of final reservation notification published by the Karnataka government.

According to reports, the verdict was delivered by a Division Bench comprising Chief Justice Abhay Shreeniwas Oka and Justice S Vishwajith Shetty on separate public interest litigation petitions filed by former councillors M Shivaraj and Abdul Wajid, the SEC, and Kalyan Nagar resident Ravi Jagan.

The direction comes as a setback to the Karnataka Government, which had notified that the number of wards under the BBMP would be increased to 243. Upholding the constitutional validity of the Karnataka Municipal Corporation Third Amendment Act (2020), the HC noted that “it will have to read it down by holding that it will not apply to elections of corporations which ought to have been held as per Article 243 of the Constitution, before the Amendment Act came into force”.

The five-year term of the incumbent BBMP Council expired in September. The election commission opposed the state government’s exercise to increase the wards as it had already begun preparations to conduct the polls for 198 wards.
