HC imposes cost on BDA Deputy Secretary for cancelling sale deed

Bengaluru: The High Court on Friday imposed a cost of Rs 25,000 each on a Deputy Secretary, Bangalore Development Authority (BDA) and Bengaluru District Additional Registrar, Stamps and Registration Department, for illegally cancelling a sale deed of a site allotted to a beneficiary in HSR Layout without following due procedure.

The court directed the State to initiating disciplinary inquiry against the two officials besides taking steps to recover the cost imposed on them from their personal resources while observing that they had caused unnecessary litigation by arbitrarily exercising their power.

Justice B. Veerappa passed the order while allowing a petition filed by Manjunath Shetty. In 2013, the BDA had allotted a site in HSR Layout Sector-III to M. Munikrishnappa and had executed an absolute sale deed in June 2013. In January 2014, the petitioner purchased the site by paying Rs. 1.2 crore to Munikrishnappa.

However, on February 27, 2015, without issuing any notice to the petitioner, the BDA cancelled the sale deed executed in favour of Munikrishnappa on a complaint that he had got the site by giving false details.
