HC summons BBMP Chief for disobeying illegal waste dumping order

Bengaluru: The High Court has asked the BBMP Chief Commissioner to appear before it to answer about the dumping of mixed solid waste at Mittaganahalli, despite a restraining order.

“Disobedience of the court’s order will not be accepted,” said a division bench led by Chief Justice Ritu Raj Awasthi, who further stated that the court will not hesitate to issue harsh orders, including jailing the errant officers.

On March 6, 2020, the court ordered that disposal of solid waste at the Mittaganahalli quarry site in northeastern Bengaluru be stopped if the Karnataka State Pollution Control Board (KSPCB) did not get authorisation within three weeks.

The order was made in response to a Public Interest Litigation (PIL) petition filed in 2012 over the failure to execute the Municipal Solid Waste (Management and Handling) Rules, 2000, and the Solid Waste Management Rules, 2016.

During the recent hearing, the petitioners informed the court that mixed waste is still being dumped on the site, despite the KSPCB counsel saying that no authorisation had been issued.

“The State Pollution Control Board’s counsel has informed the court that the pollution control board has not provided any authorisation in this regard,” it read.
