Man loses Rs 35,000 to scammers, sues bank in B’luru

Bengaluru: According to the sources, a Bengaluru man who lost Rs. 35,000 to scammers sued a nationalised bank after it failed to act despite his timely filing of an official complaint. However, the City Consumer Court ordered the bank Manager to issue a refund with interest, as well as a compensation of Rs. 10,000 for the inconvenience caused to the customer.

As per the reports, since mid-2018, Gangadhar G. D. of Nandini Layout has had a savings account at the State Bank of India’s Vidhana Soudha branch. On June 4, 2019, he received four SMS texts alerting him that Rs. 35,000 had been withdrawn from his account in four separate transactions totaling Rs. 5,000 and Rs. 10,000. When he realised his SBI account or bank card had been hacked, he went to the Police Commissioner’s office and filed a complaint. He also filed a complaint with SBI.

Despite an order from the RBI demanding action be taken and money be refunded to the customer within 90 days, the SBI authorities, including its customer helpline, refused to take action on the complaint of money loss through online fraud.

Gangadhar filed a complaint against the Branch Manager of SBI’s Vidhana Soudha branch and the Assistant Zonal Manager, customer care, SBI Bengaluru with the Bengaluru 1st Additional District Consumer Disputes Redressal Commission in Shantinagar on April 3, 2021.

According to the sources, Gangadhar’s lawyer provided evidence claiming that the illegal money withdrawal occurred at an ATM kiosk in Sullia, Dakshina Kannada, but SBI’s attorney rejected the allegations. The bank claimed that the customer had made a legal transaction by generating OTPs, but it failed to provide proof to back up its claim.

After six months of hearings, the judges found the SBI to be accountable for not resolving the customer’s complaint by not refunding his hard-earned money, and observed that the banking system’s flaws resulted in fraudsters pocketing the money. The court ordered on September 27, 2021, that the Branch Manager must return the customer Rs. 35,000, interest, as well as give him Rs. 5,000 for creating mental distress and Rs. 5,000 for court expenses.
