Married daughters can also apply for job on compassionate grounds: HC

hc ktaka 17122020Bengaluru: The Karnataka High Court has ruled that married women can also seek “compassion” employment and that marriage doesn’t mean that they are no longer part of the family. 

Making the ruling on Thursday in response to a petition filed by Bhuvaneswari Puranik, the Court stated that even after marriage, a woman doesn’t cease to be part of the parental family. The HC then directed the state government to consider Bhuvaneswari Puranik’s appeal for a job in one of its departments.

According to reports, Bhuvaneswari Puranik’s father, Ashok Adiveppa Madivalar worked as a secretary in the office of Agriculture Produce Marketing Committee in Kudachi of the Belagavi district and passed away in 2016 while on the job.

The petitioner’s application for a job on the grounds of compassion was rejected by the Joint Director (admin), Department of Agriculture Marketing as she is married. Her brother, on the other hand, had chosen not to seek the appointment as he is presently employed at a private company.

Bhuvaneswari then challenged the order at the High Court, calling the rejection discriminatory.

Hearing the petition, Justice M Nagaprasanna struck down the rules which considered only unmarried daughters as members of the family and said that it is discriminatory and unconstitutional to exclude married daughters from the purview of ‘family’.

The Court observed that the rules violate Articles 14 and 15 that prohibit discrimination on the basis of race, religion, sex or gender.

According to reports, the court order read that if the son’s marital status doesn’t affect his entitlement for seeking an appointment on compassionate grounds, “then the marital status of the daughter should not make a difference either”. The law cannot assume that married sons alone continue to be a part of the family, it added.
