Bengaluru: The Karnataka High Court quashed a magistrate court order taking cognizance without sanction for the prosecution of five Bangalore Development Authority (BDA) engineers, and sent the matter to the relevant authority to provide necessary directions regarding the grant of sanction.
“While granting sanction, the competent authority would have to examine the necessary documents and the counsel’s submissions that there was no witness against the petitioners. Further proceedings against these petitioners would be stopped due to a lack of sanction,” said Justice M. Nagaprasanna while allowing the petitions submitted by the accused engineers.
A. Krishnamurthy, K. N. Ravikumar, C. Srinivas, Shabbeer Ahmed, and Farooqe Azam, BDA officials in the cadres of Assistant Executive Engineer and Assistant Engineer, filed the petitions, questioning the magistrate court’s cognisance, which was based on a complaint filed by BDA Vigilance and STF with Sheshadripuram Police Station. It was claimed that the officials collaborated with one Indar Kumar to create documents for bogus site allotment.
