Mangaluru: Will appeal against court’s verdict, says Waqf Advisory Committee

Mangaluru: Dakshina Kannada District Waqf Advisory Committee Chairman B. A. Abdul Naseer Luckystar said that an appeal will be filed in the State High Court against verdict of the Third Civil and JMFC Court in Mangaluru in connection with the Malali Mosque case verdict that came on Wednesday November 9.

Addressing a press conference at the District Office here, he said that as per the Waqf Act, no suit can be filed or proceedings in the Civil Revenue Court or other authority on any dispute or other matter relating to any dispute or other matter relating to the Waqf Act. Accordingly, when the locals approached the Third Civil and JMFC Court in connection with the Malali Mosque issue, the mosque’s counsel filed an interim petition challenging this. But on Wednesday, the Mangaluru Court said that a civil court can conduct a hearing in connection with the property. Therefore, the earlier verdict will be challenged in the High Court after consulting legal experts in this regard and discussing with the State Waqf Board, he said.

“Disturbing messages have been circulating on social media about the verdict of the Third Civil and JMFC Court in City on Wednesday November 8 in connection with the Malali Mosque. The Court has ruled only on whether a case related to news can be heard in a civil court or not. The Malali Mosque has a history of nearly five hundred years and is registered with the Waqf Board in 2003. So we will fight against the verdict and we are confident that we will get justice,” said B. A. Abdul Nasir Luckystar
