Mangaluru: The trial in the Third Additional Civil Court in Mangaluru will continue only after the order on the petition filed in the High Court on the Malali Mosque dispute is issued.
Advocate Chidananda Kedilaya, appearing for the Vishwa Hindu Parishad, and the counsel appearing for the mosque management argued in the Civil Court in the City on Tuesday June 14. The judge, however, said that since the High Court has directed that no order should be passed in this regard, the next hearing will be held later on June 17 as per the orders of the High Court.
We do not come under the purview of the Civil Court to hear the petition filed by the VHP’s counsel as per the Waqf Act and the Place of Worship Act. Therefore, the petition in this regard should be dismissed, the counsel for the mosque management argued. The counsel for the Vishwa Hindu Parishad argued that the petition falls under the purview of the civil court and submitted the documents.
Vishwa Hindu Parishad’s counsel had moved the high court seeking an order on conducting a survey through the Commissioner on the lines of Gyanvapi before the Civil Court in Mangaluru passed an order on the jurisdiction of hearing the petition. The High Court had on Monday June 13 directed the Civil Court in Mangaluru in this regard. The High Court’s order in this regard comes as a petition was filed by Vishwa Hindu Parishad lawyers seeking a survey through the Court Commissioner in the wake of the discovery of a temple-like structure in the mosque.
