Responsibility of a lawyer is to stand for public: Justice S R Nayak

Udupi: The State Law Commission Chairman Dr Justice S R Nayak said that the real responsibility of a lawyer is to stand for the public and lead the law commission with necessary information and to guide the government to amend best possible reforms to the society.
He said that the law is introduced to gratify human needs. “We have law to fix a boundary in the society indenting to maintain peace and order. Law reflects the ideology of a society. As and when the society and its scenario changes, the need of regulatory change is a must, understanding this aspect ‘Law Commission’ was formed in 1934”, he said.

Law commission enriched the Indian statutory book to mold British law for Indian constitution.  After Independence, the constitution of India with fundamental rights and the government declared law reform. Later the demand in the parliament was to introduce central law which was introduced 1955.

In later years, law commission was established in state level too. A seven-member commission was appointed in states like Karnataka, Kerala, Tamil Nadu, Maharashtra, Gujarat, U P, Bihar and Goa.

Law Commission recommends for the statutory changes, but it has no right to do the reform. It is autonomy in terms of finance, administration and operation to carry out the functions effectively and efficiently.

The Indian Code of Civil Procedure, the Indian Contract Act, the Indian Evidence Act, and the Transfer of Property Act are the products of the labor of the first four Law Commissions, he added.
