Mangalore: Popular wildlife photographer Dr. Krishna Mohan of Moodbidri has claimed that Infosys, Mysore has used his copyrighted photograph for their invitation ‘Ambari – 2014’, a dasara programme.
Dr. Krishna Mohan, a surgeon by profession, who runs a hospital in Moodbidri said he clicked the photograph during the procession, which marked the immersion of Sharada idol as part of Dasara festival in Moodbidri on September 26, 2009.
Terming the issue as a gross copy right violation, Dr. Mohan has written a letter to Infosys, Mysore. He said, “The invitation carries my photograph on the ‘fire breathing tiger’. It has been discolored and put in their invitation without any reference or credit.”
Dr. Krishna Mohan said, he published the photo on his blog http://www.drkrishi.com/fire-breathing-tiger.
According to the Copyright Act, 1957 and Copyright (Amendment) Act, 2012, the author of the original work possesses exclusive rights including the right to reproduce the Work, and to publish and communicate the Work to the public (including by way of sale, broadcast or putting the Work online).
Dr. Mohan said it is an infringement of copyright to do any of the acts comprised in the copyright in relation to the whole or a substantial part of the Work, or to authorize such an act, without the permission or license of the copyright owner.
The photographer demanded that, either the company remove the photograph immediately in order to stop infringing the copyright or pay him a compensation of Rs.75,000/- for the use of the work.
He has written a letter to Infosys, Mysore seeking response, and he has yet to receive one.
