Former CM BSY has 16th Land denotification FIR filed against him

Date : 20-12-2015

Bengaluru: Former Chief Minister and BJP Vice president B S Yeddyurappa made the headlines yet again for having the 16th FIR over alleged denotification of land filed against him by the Lokayukta police on Saturday December 19.

The FIR registered is related to the de-notification of an acre of land in survey no. 222, Kacharakanahalli village, that the Bangalore Development Authority (BDA) had acquired in 1985 to form the HBR Layout I Stage.

Activist Jayakumar Hiremath had sought a CBI probe into the report before the High Court which directed a Lokayukta police probe.

The Lokayukta police aided by the Criminal Investigation Department had listed out 29 instances of denotification cases where a prima facie case could be made out. The Lokayukta police had begun filing a series of FIRs in all the 29 instances in May 2015.

After BSY questioned the propriety of the Lokayukta police in filing FIRs against him before the High Court as the Lokayukta institution itself is under scanner over the bribery scandal, the police abruptly had stopped going ahead with the rest of the FIRs.

Yeddyurappa secured a stay order on three of these FIRs in September 2015, the Lokayukta police on Saturday filed a new FIR in the series of 29 instances.

The CAG report stated that Yeddyurappa in January 2010 denotified the land in favour of the applicant who argued that he had been enjoying physical possession of the land and BDA had not acquired it. As per the report BSY did this by overruling the opinion of the Law Department and BDA.

Further, the CAG report observed that the land was denotified to the applicant who was not the original ‘khatedar’ of the land in 1985, when BDA notified the land. The applicant who got the land denotified in January 2010 sold it off in September 2010 for Rs. 1.5 crore.
