Land scam: HC stays action on 3 FIR’s against BSY

Bengaluru: The proceedings against BJP National Vice-president B S Yeddyurappa initiated by Lokayukta Special Court in connection with three cases of illegal de-notification of land has been stayed by the High Court here on Tuesday.

Justice Rathnakala after passing the order, admitted Yeddyurappa’s three petitions challenging the FIRs and further proceedings initiated by Lokayukta police last May in three different cases based on the Comptroller and Auditor General (CAG) report.

“Any other organ of the state, including the judiciary, can make use of the report and that would tantamount to abuse of constitutional scheme, Assistant Solicitor General of India, Krishna S Dixit, representing the CAG”, argued.

“Under the constitutional scheme of things, the CAG report is exclusively meant for treatment either by parliament or the state legislature as the case may be,” Dixit added.

As many as 13 FIRs have been registered against Yeddyurappa and Lokayukta police are yet to file 30 more FIRs based on CAG report. However, the stay is restricted only to the three FIRs.
