The Karnataka High Court has stayed an FIR against the son of a BJP leader from Puttur, who was accused of repeatedly sexually assaulting a former classmate on the false promise of marriage.
The interim stay was granted while the court heard the 22-year-old petitioner’s plea seeking quashing of the FIR.
Monthly payment condition imposed
While granting relief, the High Court directed the petitioner to pay ₹75,000 per month to the complainant until disposal of the quashing petition.
The condition forms part of the interim order passed during the ongoing legal proceedings.
Allegations in complaint
According to the complaint, the woman alleged that the accused had repeatedly assaulted her after promising marriage.
Reports further stated that she later became pregnant and gave birth to a child.
The allegations are subject to judicial examination, and the case remains under consideration.
Court to examine petition
The petitioner has approached the High Court seeking cancellation of the FIR.
A stay on an FIR at this stage does not amount to acquittal or final closure, but temporarily halts further coercive action while the matter is examined.
Further hearings are expected in the case.
Sensitive matter under legal scrutiny
Cases involving allegations of sexual assault and promise of marriage often involve complex factual disputes, consent questions and evidentiary review.
Legal experts note that courts usually examine complaint timelines, documentary evidence and surrounding circumstances before arriving at conclusions.
