Chitradurga: POCSO case, court rejects bail plea of accused

Chitradurga: Second Additional District Judge B. K. Komala on Monday October 10 denied the anticipatory bail plea made by the fifth and fourth accused, N. Gangadhara and A. J. Paramashivaiah, in the POCSO case involving SJM Matha pontiff Dr. Shivamurthy.

In the judgment, she said, “As per Section 17 of the Protection of Children Sexual Offences Act, whoever abets any offence under this Act, if the act abetted is committed in consequence of the abetment, shall be punished with the punishment provided for that offence.”

She added that the offence is punishable by death or life in prison under Section 6 of the same Act. As a result, anticipatory bail is denied since the petitioners are accused of very serious and grave offences.
