Minor sexual assault case: High Court cancels bail granted to accused

Bengaluru: The High Court on Tuesday cancelled bail granted by a trail court to an rape accused and said that the trial courts should keep in mind the gravity of offence, particularly in minor sexual assualt cases while considering a bail plea.

Chandrashekara denying bail to accused Nagaraj said that reasons like investigation was over and accused was in judiciary custody during pendency of investigation were not cogent reasons to grant bail in cases of sexual offences against children.

The court has asked the accused to surrender immediately before the trail court, which was directed to complete the trial within two months.

The High Court said the trial court, instead of granting bail, should have taken up trial at the earliest as the accused was booked under Protection of Children from Sexual Offences Act, 2012.
