Kadaba: The 5th Additional District and Sessions Court in Puttur has sentenced 60-year-old Jayananda K of Kodimbala in Kadaba to 10 years of rigorous imprisonment in connection with an acid attack case reported in the area.

The court also imposed a fine of Rs 3 lakh on the accused under Section 326A of the Indian Penal Code (IPC). The verdict was pronounced by judge Sadananda Nagappa Naik after hearing the case.

Jayananda K was convicted in Crime No. 06/2020, which was registered in connection with the acid attack. The case initially invoked several provisions of the IPC, including Sections 354A, 509, 504, 506, 448, 307 and 326A.

Court imposes 10-year sentence

Under Section 326A of the IPC, which deals with causing grievous hurt through the use of acid, the court sentenced Jayananda K to 10 years of rigorous imprisonment.

In addition to the prison sentence, the court imposed a fine of Rs 3,00,000. The court ordered that if the accused fails to pay the fine, he will have to undergo an additional two years of simple imprisonment.

The court also convicted him under Section 504 of the IPC. For this offence, Jayananda K was sentenced to one year of imprisonment and fined Rs 5,000.

Failure to pay the second fine will result in an additional three months of simple imprisonment, according to the court’s order.

The sentences and fines were imposed after the court considered the evidence presented during the trial and the investigation carried out by the police.

Police investigation led to charge sheet

The case was investigated by then Puttur Women’s Police Station inspector Kusumadhara.

During the investigation, the officer conducted a detailed probe, collected evidence connected to the alleged offence and subsequently submitted the charge sheet against Jayananda K before the court.

The investigation formed the basis for the prosecution’s case during the trial. Evidence and other materials gathered by the investigating team were presented before the court as the proceedings continued.

The case was registered under multiple sections of the IPC, reflecting the allegations made in connection with the incident. Section 326A was among the principal provisions invoked in relation to the acid attack.

Following the completion of the investigation and filing of the charge sheet, the case proceeded before the 5th Additional District and Sessions Court in Puttur.

Prosecution presents case

Public prosecutors Krishnaveni, Harishchandra Udyavar, Prakash Chandra Shetty and Jayanthi K represented the state during the proceedings.

The prosecutors argued the case before the court and presented the prosecution’s evidence in support of the charges against the accused.

After hearing the arguments and examining the material placed before it, judge Sadananda Nagappa Naik delivered the verdict sentencing Jayananda K to rigorous imprisonment.

The court’s order includes separate punishments for the offences under Sections 326A and 504 of the IPC, along with financial penalties and additional imprisonment in case the fines are not paid.

Verdict brings case to sentencing stage

The sentencing marks the conclusion of the trial proceedings against Jayananda K in the acid attack case registered in 2020.

The accused, a resident of Kodimbala in Kadaba, will serve the sentence imposed by the court under the provisions mentioned in the judgment. The court has also specified additional periods of imprisonment in the event of non-payment of the respective fines.

The case highlights the serious legal consequences associated with acid attacks, with Section 326A of the IPC providing for stringent punishment for causing grievous hurt through acid.

The prosecution’s case was built on the investigation conducted by the police and the evidence subsequently placed before the court. Following the hearing, the court found the accused guilty and imposed a 10-year rigorous imprisonment sentence along with a Rs 3 lakh fine under Section 326A.

The additional sentence and fine under Section 504 were also imposed by the court.
