NIA an agency towards integrity surpassing dignity

NIA (National Investigation Agency) is the current trending name in the town. It was in the year 2008, with the 26/11 terror attack in Mumbai the then government in India understood the lack of efficient intelligence team working in the country in order to protect the sovereignity, Integrity and security of India, the NIA was formed.

The agency has the power to undertake investigation of the terror related crimes throughout the states of India without special permission from the states. And it is done under the written proclamation from the Ministry of Home Affairs. The recent task of NIA throughout the nation also served the process towards banning an organisation registered under Societies of Registration Act, 1860.

The process of ban involves the analysis of threat in the country. The complaints and FIR by state government can too be considered in the process. The organisations which are imposed ban too have their right to prove their side and so a tribunal works in this regard. In case the centre proves its side for the ban in the tribunal, the accused organisation has the provision for appeal in the High Court.

In the process of working on the security and Integrity of the country NIA has its own administrative loopholes. Law and order and the state subjects and the police in the state are responsible for the same. NIA acts as a superseding power in the state which directly works under Central Government. It indeed is a question on federal character of the nation. The dominance of Ministry of Home Affairs in dealing with issue also effects the independent working of the agency. The arrest and the targets under the central agencies time and again are questioned for the political gains it gives for the ruling party.

One among the important goals of NIA is the protection of Human Rights and Dignity of the individual but the recent arrest happened at the time when people where in deep slumber questions the integrity of the agency. A women, wife of the accused complains of her sanitary pad being searched in the name of investigation. The lady questions on the liberty of herself and her family to have a peaceful sleep at night in their own house.

Prioritising the integrity of the nation with independence of work the agency should initiate in upholding the human dignity.
