A restaurant’s promotional TikTok video has sparked a major privacy row in Italy after a married man claimed the clip exposed his secret relationship, leading to the collapse of his marriage and triggering legal action against the establishment.
The case involves a 42-year-old man from Catania in Sicily, who says a casual dinner turned into a life-altering episode after he was filmed without consent and featured in a viral social media post.
How the affair was revealed online
According to Italian media reports, the man had told his wife he was attending a routine business dinner. Instead, he spent the evening at a restaurant with a woman described as his secret partner. During the dinner, staff were filming promotional content for the restaurant’s social media accounts.
The man claims he was unaware he was being recorded and never consented to appear in any video. The footage was later uploaded to TikTok as part of the restaurant’s marketing campaign. Soon after, the video gained traction online — and was allegedly seen by his wife, who recognised him in the clip.
Reports say she confronted him and shortly after decided to end the marriage, asking him to leave their shared home.
Legal action backed by consumer rights group
Following the fallout, the man approached Codacons, a prominent Italian consumer protection body, which is now pursuing legal action on his behalf.
Codacons argues that the restaurant violated the man’s right to privacy by filming and publishing identifiable footage without explicit permission. Francesco Tanasi, a Codacons representative, said businesses cannot assume customers agree to appear in promotional content simply because they are in a public venue.
“In certain cases, publishing a video can have very serious consequences for a person’s private and family life,” Tanasi said, adding that consent must be clear and informed.
Possible escalation to privacy watchdog
Codacons has warned that the matter could be taken beyond civil court to Italy’s national privacy authority if required. Under Italian and European data protection rules, strict limits apply to the collection and publication of personal images without consent.
If violations are established, the restaurant could face financial penalties and further legal consequences.
