The National Company Law Tribunal (NCLT), Bengaluru Bench, has issued notice to Flipkart in an insolvency petition filed by Applabs Media Private Limited over an alleged operational debt of ₹1.69 crore.
The order was passed by a bench comprising Judicial Member Mahendra Khandelwal and Technical Member Radhakrishna Sreepada.
Dispute over unpaid marketing services
According to Applabs Media, the claimed debt arises from three invoices worth ₹1.69 crore raised under a Marketing Agreement signed on December 5, 2019.
The company stated that it was engaged to provide cost-per-transaction campaign services for events conducted through mobile applications and other digital platforms. It contended that the invoices were raised as per the agreement and were payable within 45 days, but the dues remain unpaid despite services being rendered.
Creditor cites admission of liability
The operational creditor informed the tribunal that a demand notice under Section 8 of the Insolvency and Bankruptcy Code (IBC) had been issued to Flipkart, following which a reply was received.
Applabs Media argued that there was no pre-existing dispute regarding the invoices and relied on an email dated May 8, 2023, along with a reconciliation statement shared on May 15, 2023, which it claims reflects an admission of liability by Flipkart.
Tribunal schedules hearing
After recording the submissions, the tribunal directed that notice be issued and listed the matter for further hearing on July 14, 2026.
The bench observed that Flipkart should file its response and appearance before the next hearing date.
Second insolvency plea against Flipkart
This is the second insolvency-related petition recently brought before the NCLT Bengaluru involving Flipkart. In a separate case filed by Netambit Value First Services Private Limited, the tribunal had also issued notice on a plea seeking initiation of corporate insolvency resolution proceedings against the e-commerce giant.
The matter will now be taken up on July 14
