A man has approached the Delhi High Court, requesting directions for the Delhi Police to conduct a gender test on his wife at a Central government hospital. He claims that his wife is a transgender person, which she allegedly concealed before their marriage, causing him mental distress and preventing their relationship from being consummated. The man argues that this concealment has led to false legal cases against him.
Represented by Advocate Abhishek Kumar Choudhary, the plea emphasizes that while gender identity is personal, the rights of both parties in a marriage are intertwined. For a fair marital life, it’s important to balance their constitutional rights under Article 21. The petitioner also argued that he should not be subjected to laws designed for women if his wife does not meet the legal definition of a “woman.”
The petitioner had earlier sought the formation of a medical board for his wife’s examination through a trial court, which dismissed his request.
