SCBA Criticizes Chief’s Letter to President Murmu on Electoral Bonds Verdict

The executive committee of the Supreme Court Bar Association made a statement on Tuesday distancing itself from a letter penned by SCBA chief Adish C Aggarwala, regarding the presidential reference of the apex court judgment in the electoral bonds scheme case. The association criticized the letter, denouncing it as an effort to exceed its jurisdiction and undermine the Supreme Court’s authority.

Adish C Aggarwala, who also serves as the chairperson of All India Bar Association, wrote to President Droupadi Murmu, urging her not to implement the verdict in the electoral bonds scheme case unless the apex court reconsiders the matter. In his letter, Aggarwala argued that disclosing the names of corporates contributing to political parties could expose them to potential victimization, particularly by parties receiving lesser contributions. He emphasized the detrimental impact on corporate donations and democratic engagement if such sensitive information were disclosed retroactively.

Although the letter bore the letterhead of the All India Bar Association, it listed Aggarwala’s designation as President of the SCBA below his signature.

In response, the Executive Committee of the Supreme Court Bar Association clarified that its members neither authorized the President to write such a letter nor endorsed the views expressed therein. They condemned both the act and the contents of the letter, interpreting them as an attempt to overstep the bounds and undermine the authority of the Supreme Court of India.
