New Delhi: In an emotional moment during a property dispute between a mother and her son, the Supreme Court urged the son to apologise to his mother and seek her blessings before dismissing his challenge to a lower court order.
Court reminds son of his mother’s place
A Bench comprising Justice Satish Chandra Sharma and Justice N K Singh was hearing the son’s appeal against orders favouring his parents in a property dispute.
During the hearing, Justice Sharma orally asked the son to touch his mother’s feet and apologise for what he had done. The judge also emphasised the importance traditionally attached to one’s mother and encouraged the son to seek her forgiveness and blessings.
The Supreme Court subsequently dismissed the son’s special leave petition, leaving in place the earlier orders of the trial court and Delhi High Court.
Parents sought possession of their property
According to the case, the mother and her husband were the sole owners of the disputed property. They had allowed their son and daughter-in-law to occupy the first floor without paying rent, as permissive licensees.
The parents later alleged that the couple had harassed them and pressured them to transfer the property in their favour. They also alleged that claims of ownership were supported by fabricated documents.
The parents eventually terminated the licence, asked the couple to vacate the property and approached the court seeking possession, permanent injunction and damages.
The trial court ruled that the parents were the lawful owners and that the son’s licence to occupy the property had been validly terminated. The Delhi High Court upheld that decision on April 17.
The Supreme Court’s dismissal has now brought the legal challenge to an end, while the judge’s appeal for reconciliation added a deeply human dimension to the family dispute.
