Agra: A school boy has been served a legal notice by his school in Agra for asking the management as to why he was not promoted.

The legal notice of Rs 1 cr has been claimed by the school as damages!

It is said that Mohommed Shehjan, a Class VIII student of St Francis School failed in his final examination.

When the results were declared, Shejan’s father Mohommed Sageer, a mechanic by profession moved to the District Education Department stating that his son has not been promoted despite the Right to Education Act (RTE) stating clearly that no student can be failed by the schools up to Class VIII.

The officials, in turn, sought an explanation from the school principal. After the school management failed to reply to the letter, education officials sent a reminder notice to the school management, which too was ignored.

Sageer then sent a legal notice to the school seeking the same information. In reply, the school also sent a legal notice to the student seeking damages of Rs 1 crore for “harming the reputation” of the school.

“Either tender an unconditional apology or pay damages of Rs 1 crore within 15 days,” the notice said, reports Deccan Herald.

However, the school, on the other hand has argued that since it is a minority school, it need not abide by the RTE Act.

Shehjan, who has been an academically bright student, says that he had studied at the same school from Lower Kinder Garten and he has never failed in any class so far.
