The Supreme Court has ruled in favor of Nikita Singhania, granting her guardianship of her four-year-old son after her estranged techie husband, Atul Subhash, died by suicide. The decision came after Atul’s mother, Anju Devi, filed a plea to obtain custody of her grandson, claiming the child’s safety was at risk under his mother’s care.
During the hearing, the court, led by Justices BV Nagarathna and Satish Chandra Sharma, spoke with the child via video conference before delivering its judgment. The Bench rejected Anju Devi’s petition, describing her as unfamiliar to the child and highlighting that legal outcomes should not be influenced by media narratives.
Atul, a software engineer, ended his life on December 9, 2024, leaving behind a detailed 24-page note and an 80-minute video accusing Nikita and her family of extortion and harassment. He alleged that nine cases had been filed against him and his family to extract money. Following these claims, Nikita, along with her mother and brother, was arrested but released on bail earlier this month.
Despite the allegations against her, the court prioritized the minor’s well-being, ruling that the mother remains the natural guardian. Anju Devi’s fears over the child’s safety were dismissed, and the court emphasized that custody decisions must serve the child’s best interests.
