Delhi High Court adjourns DKShi’s bail hearing to Oct 14

Bengaluru/New Delhi: Congress strongman and former minister D K Shivakumar’s stay at the Tihar jail just got longer, as the Delhi High Court adjourned his bail plea hearing to October 14. The single-judge bench of Justice Suresh Kumar Kait court also issued a notice to the Enforcement Directorate (ED) in the case.

The bail hearing was taken up by the single-judge bench of the High Court last Thursday, and was adjourned to today, September 30, after arguments and counter-arguments, were made.

On Monday, Senior Advocate Dayan Krishnan, who is representing DKShi, argued that the Prevention of Money Laundering Act (PMLA) case against him could not be sustained in view of the absence of a predicate offence.

He argued that predicate offence in the case, i.e. Section 276C(1), 277 and 278 IT Act, was not a scheduled offence under the PMLA, and thus the ED had no jurisdiction to initiate the investigation.

The court then issued a notice to the ED after briefly hearing Krishnan and adjourned the hearing to October 14.

It can be recalled that DKShi was remanded to a 14-day judicial custody on September 17, which ends on October 1.
