HC adjourns hearing on plea seeking action against 78 MLAs

Bengaluru: The Karnataka High Court on Monday adjourned the hearing on a petition to next week. The petition has sought a direction to the Karnataka Lokayukta for initiating action against 78 MLAs for intentional insult and bringing disrepute to Upalokayukta Subhash B. Adi by their action of moving a motion in the Legislative Assembly to impeach Adi.

A Division Bench comprising Justice H.G. Ramesh and Justice B.M. Shyam Prasad adjourned further hearing while asking the petitioners, Subhash Iyer, and Prakash Babu B.K, co-presidents of Janaadhikaara Sangharsha Parishath, a social organisation, who argued the petition personally, to do research on the legal position on whether any action could be initiated against elected representatives for exercising their right provided under the law to move such impeachment motion.

Pointing out the failure of impeachment motion after a sitting judge of the High Court gave a report in May 2016 negative all the five charges levelled against Adi in the motion, the petitioners said they had lodged a complaint before Lokayukta seeking action against 78 MLAs under Section 17(2) of the Karnataka Lokayukta Act for intentional insult and bringing disrepute to Adi. However, the Lokayukta had rejected their complaint that it was not maintainable in law.
