HC orders stay in DKShi’s mother’s benami property case

Bengaluru: The state High Court has issued a stay on Thursday, June 20, against the showcause notice by the Income Tax department to Gauramma, mother of State Water Resource Minister D K Shivakumar and accused in a benami property case.

Earlier, the Benami Property Transaction division of the I-T Department had issued a showcause notice to Gauramma and asked her to provide necessary information within 90 days.

Meanwhile, her lawyer had filed an application in the Karnataka High Court to stop the notice.

HC has now postponed the hearing on the case by issuing a notice to the I-T department.

Gauramma’s lawyer had placed a set of arguments before the court stating she was receiving income from agricultural produce and that her family had several lands. It was also stated that there were amendments that were brought to the Benami Property Transaction Act in 2016 and that this act did not hold good.

It may be recalled that when the I-T officials had raided DKShi’s houses in 2017 in Kanakpura and Delhi, they had reportedly found asset documents in the name of his mother Gauramma. Based on this, I-T department had issued a notice to seize the lands that she owned under the Benami Property Transactions Act, 2016.
