Bengaluru: In a significant ruling, the Karnataka High Court granted permission on Tuesday for 13 couples to pursue surrogacy and conceive children using donor sperm.
The court reviewed a series of petitions challenging Rule 7 of the Surrogacy (Amendment) that took effect on March 14, 2023. Justice Nagaprasanna, leading a single-judge bench, remarked, “The recent surrogacy amendment imposes limitations on using donor sperm. However, it is inappropriate to apply a blanket approach. Each case should be examined individually and exceptions can be made in accordance with the rules,” stated the court.
As per the petitions submitted by 13 couples, some wives face challenges in conceiving due to health issues, including a case involving heart disease. On March 14, 2023, the central government issued a notification amending clause (1)(d) of Form No. 2 in the Surrogacy Rules.
