Shivanand Circle steel flyover: HC disposes of PIL

Bengaluru: The Karnataka High Court on Monday asked a group of petitioners, who have questioned the legality of the proposal to construct a steel flyover at Shivananda Circle in a public interest litigation (PIL), to submit a representation to the Principal Secretary, Urban Development Department, on their complaints against the project.

A Division Bench comprising Chief Justice Subhro Kamal Mukherjee and Justice P.S. Dinesh Kumar passed the order while disposing of the PIL, filed by K.S. Prasad and 25 others, who are residing in the localities around Shivananda Circle.

The Bench also asked the Principal Secretary to take a decision within two months of receipt of the representation after securing the views of all the concerned, including the petitioners.

It was claimed in the petition that the project is contrary to law as the same has not been included in the Revised Master Plan of 2015 or it has been approved by the Bengaluru Metropolitan Planning Committee.

The petitioners have also contended that there is no reference to any public consultation in the project report prepared in January 2014 and any impact assessment report. Pointing out that there is no reference to present cost of the project in the Government Order issued on July 24, 2017, the petitioners claimed that estimated Rs. 50 crore as cost of the project made in 2013-14 is not relevant at present.
