State govt to roll back ban on pillion riding on bikes less than 100cc

Bengaluru: Facing flak over its recent circular prohibiting pillion riding on bikes with less than 100cc engine capacity, the state government is likely to roll back the same.

An amendment to the existing Section 143/3 of Karnataka Motor Vehicles Act, 1989 will soon be done, assured transport minister H M Revanna speaking at the district police parade ground in Raichur.

The circular was issued by the transport department after a directive from the state high court asking the departments concerned to ensure enforcement of the Act while hearing a case in which a minor was killed in an accident riding on a two-wheeler below 100 cc.

The minister said that the High Court had sent notices to transport, Police and the education department while hearing a road mishap case in 2016,but none replied to the notice. “This led the high court to view it as a violation and send a notice to the government, following which we had to abide by the rule,” he said.

According to the rule, which exists only in Karnataka state no pillion seat shall be attached to a motorcycle with engine below 100 cc capacity.

Further he mentioned that it needs to be seen whether the rule can be amended through an executive order. “If not, we will push the amendment in the Belagavi session of the Assembly starting November 13,” he added.
