Mangaluru: The District Consumer Disputes Redressal Commission has instructed Bajaj Finance Limited to furnish all necessary loan-related documents and issue a No Objection Certificate (NOC) to a complainant, citing inadequate service. Additionally, the company must compensate him ₹25,000 for inconvenience and reimburse ₹10,000 in legal expenses for failing to address his concerns on time.
Borrower’s Struggle for Justice
Mohammed Nawaz (30) from Mallur Village, Mangaluru, approached the commission after Bajaj Finance declined to provide an NOC for his auto-rickshaw loan taken in 2018 from the Moodabidri branch under Agreement No. L3WMLR06324087. Nawaz had dutifully repaid his ₹1.9 lakh loan in 60 EMIs of ₹5,526 each. Despite clearing ₹3,28,500.16, he was stunned when the company refused to issue the NOC, claiming an unexplained outstanding balance of ₹1,22,356.76.
Legal Battle & Verdict
With no response from Bajaj Finance despite legal notices, Nawaz filed a complaint under Section 35 of the Consumer Protection Act, 2019. The company argued he had defaulted, citing an extended tenure of 77 months due to a COVID-19 moratorium. However, the Commission found no valid justification for the additional dues and ruled in Nawaz’s favor.
Bajaj Finance must comply within 30 days, failing which further legal action will follow.
