Three teenage girls, including two minors, have filed a class-action lawsuit against Elon Musk’s artificial intelligence company xAI, alleging that its Grok image generator was used to create and circulate child sexual abuse material (CSAM) using their photographs without consent.
Allegations of misuse of AI technology
The lawsuit, filed in California though involving teenagers from Tennessee, claims that AI-generated nude images of the girls were created and shared online through platforms such as Discord and Telegram. The complaint states that the images were derived from real photographs taken when the victims were minors, including school event pictures.
According to the plaintiffs, the content was generated using a third-party application that relied on xAI’s Grok technology. Despite not being directly created on Grok’s platform, the lawsuit argues that xAI remains responsible as it provides the underlying infrastructure and profits from licensing its AI tools.
Legal action and investigation
The case came to light after one of the victims was alerted by an anonymous message on social media about the circulation of manipulated images. Upon reporting the matter, law enforcement authorities arrested a suspect and reportedly recovered CSAM on his device, allegedly created using AI tools linked to Grok.
Legal representatives for the teenagers have accused xAI of negligence, stating that the company failed to implement adequate safeguards to prevent misuse of its technology. The lawsuit seeks damages for emotional distress, reputational harm, and long-term psychological impact.
