Mumbai: Bollywood actress Koena Mitra has been sentenced to six months imprisonment by the Metropolitan Magistrate’s Court here on Monday, July 22, in a cheque bounce case.
Model Poonam Sethi had filed a case against Koena about six years ago for not repaying the amount that Koena had borrowed from her in the form of a loan.
It is estimated that Koena had borrowed around Rs 22 Lakh loan from Poonam for over a period of time. When Koena had issued a cheque of Rs 3 Lakh to Poonam, the bank had dishonoured it.
As Poonam had filed a complaint in the court regarding the cheque bounce, Koena, on the other hand, had completely rejected the allegations that Poonam had made. However, in the court proceedings, Magistrate Ketaki Chavan had dismissed all the arguments that Koena had kept forth.
On July 19, 2013, Poonam had sent a legal notice to Koena and filed a complaint in the court in the same year. During the proceedings, Koena placed a new set of argument before the court, stating that Poonam had stolen all her cheques and that she was illegally lending money.
After listening to the arguments, the court had come to the conclusion that the arguments were contradicting.
According to a report, the court has observed that the bank dishonouring the cheque on the basis of payment stopped by drawer and insufficient funds were contradicting.
The court has also said that, if assumed, that the complainant (Poonam) had stolen the blank cheques from the accused (Koena) and misused it, then to stop it from getting misused was well in the hands of the accused, but she had not attempted to do so.
Hence, it has believed that the accused Koena Mitra was trying to escape from being liable to the offence.
