Amit Shah on new criminal laws: ‘Nyay’ instead of ‘dand’

Union Home Minister Amit Shah declared today that India’s new criminal laws are centered around justice for victims. Speaking at a press conference, Shah commended the nation on achieving a fully indigenous criminal justice system, aligned with Indian values, 77 years after independence. He emphasized a shift from colonial-era laws to those enacted by the Indian Parliament, effective from July 1.

Shah highlighted key reforms, stating, “Instead of punishment (‘dand’), it’s now about justice (‘nyay’). We are ensuring swift trials and justice, protecting not just police rights but also those of victims and complainants.”

 

The minister outlined the replacement of the Indian Penal Code with the Bharatiya Nyaya Sanhita, the Criminal Procedure Code with the Bharatiya Nagarik Suraksha Sanhita, and the Indian Evidence Act with the Bharatiya Sakshya Adhiniyam, all effective immediately.

Key provisions include enhanced penalties for crimes against women and children, such as life imprisonment for gang rape and the death penalty for rape of minors. Shah also introduced new measures like recording victims’ statements at home in the presence of female officers and online FIR filing to protect privacy.

Addressing technological readiness, Shah noted that nearly all police stations are now computerized, anticipating future advancements. He underscored the laws’ passage last year and their Presidential assent, culminating in today’s implementation.

To spread awareness, special events across all police stations will educate various segments of society about these reforms, slated to transform India’s criminal justice landscape from today onwards.
