Expelled TMC MP Mahua Moitra Faces Eviction from Govt Bungalow

In a recent development, the Directorate of Estates has dispatched a team to carry out the eviction of former Trinamool Congress MP Mahua Moitra from her government bungalow in Delhi. This action follows the Delhi High Court’s denial of a stay on the eviction notice issued to Moitra, directing her to vacate the allotted residence.

According to a report by PTI, an official confirmed the initiation of the eviction process, stating, “A team has been sent to evict the TMC leader from the government bungalow allotted to her as an MP.”

Moitra, in her plea challenging the eviction notice issued by the Directorate of Estates, had cited medical reasons, emphasizing her recent surgical procedure and hospitalization in a private facility.

During the court proceedings, Senior advocate Brij Gupta, representing Moitra, argued that her expulsion from the Trinamool Congress and subsequent loss of MP status should not result in immediate eviction, especially considering her health condition.

However, Justice Girish Kathpalia pointed out that there was no specific rule presented to the court addressing the eviction of MPs from government accommodation after their tenure as lawmakers conclude. The court emphasized that Moitra was allocated the government residence due to her status as an MP. As her MP status ceased following expulsion, and the Supreme Court had not stayed the expulsion despite providing a hearing, the court concluded that Moitra currently holds no legal right to continue residing in the government bungalow.

The Directorate of Estates’ move to enforce the eviction underscores the legal stance that Moitra’s former status as an MP is the basis for her entitlement to the government accommodation, and her expulsion has resulted in the loss of this entitlement.
