Bengaluru: Social activist and President of Karnataka Police Maha Sangha V Shashidhar has sought sanction of prosecution from Governor Vajubhai Vala against Chief Minister Siddaramaiah for alleged nepotism and misuse of power in the appointment of a legislator to a public office.

“I have petitioned Governor Vajubhai Vala to permit him to initiate proceedings of criminal in nature under Prevention of Corruption Act and various sections of IPC against Chief Minister Siddaramaiah for illegally appointing Hoskote MLA N Nagaraj to the post of Chairman of Bengaluru International Airport Area Pkanning Authority,” Shashidhar said.

The petition was submitted to the Governor on September nine. Sahshidar contended that Nagaraj is not a resident of a location which does not fall into BIAAPA jurisdiction.

“The Congress legislator is a resident of Garudacharpalya, instead, and hence it is a violation of government rules,” he pointed out.

He also said Nagaraj does not have any experience of town planning at least for one year in bodies such as municipalities, village panchayats and planning authorities, among others.

Also, Shahshidhar said Nagaraj is not qualified as town planner or architect or engineer, practicing for not less than five years.

“Nagaraj also is not a specialist like an economist, geographer, sociologist or legal practioner, and hence he is not qualified to hold the said post,” he added.

Shashidhar also alleged Siddaramaiah has exceeded his jurisdiction and committed a brazen act in violation involving himself in the illegal act of appointment of Nagaraj.

He also said due political pressure, compulsion and extraneous reasons Siddaramaiah has directed the Chief Secretary to appoint Nagaraj, notifying the earlier orders.

Shashidhar also alleged Siddaramaiah had written a letter to the chief secretary to provide cabinet rank to Nagaraj on being anointed as BIAAPA Chairman.

Recommendation made by Chief Minister in getting undue benefits to Nagaraj constitutes an offence under section 13 (1) (d) of Prevention of Corruption Act and also under 120 (b) of IPC, Shashsidhar said.

These unwanted political appointments made to various boards and corporations has not only caused huge losses to the state exchequer, but also has resulted in great deal of injustice done to people, he said.

Shashidhar also alleged several letters in the form of minutes is said to have been attributed by Chief Minister in such appointments to various boards and corporations over-riding all norms and procedures in the guise of administrative actions and reasons.
