Apartment owners and buyers in Karnataka now have something to look forward to since chief minister DK Shivkumar’s recent announcement on safeguarding their rights by introducing a uniform law (downloadable PDF) throughout the state.
This was, mainly in response to BJP MLA LA Ravi Subramanya’s motion on ensuring property ownership in Bangalore, which stated that the division of land is unfair and could have major consequences decades down the line, also paving the way for a lot of unfairness and cheating from the side of landlords.
The announcement, which the chief minister made on Tuesday clearly stated that the government has been working on the new laws, which will soon abolish the previous laws set by the Karnataka Ownership Act of 1972 that registers resident associations under cooperative societies.
The new laws will however, retain the rules of the Karnataka Real Estate Regulation and Development (RERA) of 2017.
The main beneficiaries here will be the residents of Bangalore, who are known for their apartment oriented realty activities. However, the act will cover all the cities and towns of the state.
The chief minister made it clear that it is only the unauthorized and illegal developers who follow unfair practices. The regular developers, on the other hand, follow fair practices of handing over all necessary documents to the required association for a comprehensive mapping.
