Haveri: In a significant development, the Hon’ble Karnataka State Administrative Tribunal (KSAT) has quashed the suspension and transfer orders issued against Bharat Hegde, the Taluk Panchayat Executive Officer (EO) of Haveri. The tribunal’s ruling brings relief to Hegde, who had been embroiled in allegations of misconduct and unprofessional behaviour.
Tribunal’s decision
The KSAT decision invalidates both the suspension and transfer orders issued by the Rural Development and Panchayat Raj Department. The tribunal found procedural lapses and insufficient grounds in the actions taken against Hegde. Copies of the judgment have been made available (1, 2), reinforcing the tribunal’s stance on the matter.
Background of the case
Bharat Hegde was transferred to Dandeli PT on July 29 and relieved of his duties on July 30. However, he contested the transfer order and obtained an injunction from the KSAT, reinstating himself to his original position on August 1 without informing his superiors.
His suspension stemmed from allegations of absence during critical rainfall in Haveri, which led to significant damage to homes and crops. Hegde was also criticised for missing a quarterly progress review meeting and failing to respond adequately to a show-cause notice.
Implications of the ruling
The KSAT ruling restores Bharat Hegde’s position and nullifies the disciplinary measures against him. It emphasises the importance of following due process in administrative actions.
While the tribunal’s decision marks the end of a contentious chapter, it serves as a reminder of the need for transparent and fair handling of such cases to maintain the integrity of governance.
