Karnataka High Court Takes Suo Motu Cognizance of Non-Compliance

The Karnataka High Court, led by Chief Justice NV Anjaria and Justice Krishna S Dixit, has initiated suo motu proceedings regarding the failure of state authorities to adhere to orders issued under the Contempt of Courts Act. In response to observed instances of non-compliance, the Court emphasized the importance of swift obedience to judicial directives, highlighting the impact of delayed justice on public confidence in the legal system.

The Court expressed concern over the casual and indifferent attitude of authorities towards implementing court orders, stating that such behavior cannot be tolerated. It underscored the significance of government commitment to respecting court rulings as a measure of democratic values.

In its interim order, the Court outlined instances where its directions were not adhered to by relevant authorities, indicating a disregard for judicial mandates. As a result, the Court issued notices to the State of Karnataka and directed the Registrar General to enlist all state government departments as respondents.

Furthermore, the Court extended its notice to semi-governmental bodies and statutory corporations, including the Bengaluru Development Authority (BDA), Bruhat Bengaluru Mahanagara Palike (BBMP), and Karnataka Industrial Area Development Board (KIADB). These entities, as integral components of the state, were reminded of their responsibility to comply with court judgments and orders.

The Court posed several questions to the respondents, seeking clarification on the mechanisms in place for processing court orders and ensuring their timely implementation. It stressed the importance of disciplinary measures against officials found guilty of non-compliance.

Emphasizing the need for streamlined procedures to enforce court directives, the Court clarified that these proceedings were aimed at benefiting litigants by ensuring prompt execution of court rulings. The matter is scheduled for further hearing on June 5, with respondents required to submit their responses by then.
