Karnataka HC Temporarily Suspends Ban on ‘Fierce and Hazardous’ Dog Breeds

Bengaluru: In a recent development, the High Court has issued a temporary halt on the implementation of a government notification that prohibits the keeping of ‘ferocious and dangerous’ breeds of dogs. This decision came after Justice M Nagaprasanna considered a petition filed by Bengaluru residents, King Solomon David and Mardona Jones.

The notification, which aimed to ban specific dog breeds and mandated the sterilization of existing pets, raised concerns regarding the identification of dangerous breeds. The petitioners’ counsel argued that discerning these breeds required expert knowledge and highlighted the similarity of certain breeds found in India that were not covered by the notification.

The Deputy Solicitor General of India defended the notification, citing an order from the Delhi High Court in a Public Interest Litigation (PIL). However, he acknowledged that the Delhi High Court had directed the government to consider the petitioners’ representation and consult all stakeholders within a specified timeframe.

Justice Nagaprasanna emphasized the importance of consulting all stakeholders, including the Kennel Club of India, before making such decisions. Until the Deputy Solicitor General provides documentation regarding the decision-making process behind the notification, the court has stayed its implementation in Karnataka.

The court has scheduled further proceedings on April 5, 2024, to address the matter comprehensively.
