Legal Battle: Eshwarappa Moves to Court Over Usage of Modi’s Photo

Shivamogga: Former Minister KS Eshwarappa, who announced his candidacy as an independent candidate from the Shivamogga Lok Sabha constituency in the upcoming election, has approached the court regarding the usage of Prime Minister Narendra Modi’s photograph during his campaign.

Eshwarappa has filed a caveat in the local court, anticipating that someone might attempt to legally prevent him from using the PM’s photo. He claims the right to use the PM’s photo, citing constitutional provisions.

According to the sources, if someone files a complaint to prevent this, the caveat has been filed to safeguard his rights. The sources said, Eshwarappa’s calculation is the caveat’s validity would be three months, by that time the elections would be over, making legally unable anyone to obtain a stay on the usage of the photo.

In response to criticism from his opponent, BJP candidate BY Raghavendra, for using the PM’s photo, Eshwarappa responded that Modi is not his father’s asset.

Eshwarappa had expected a BJP ticket for his son KE Kantesh, who had prepared to contest the Lok Sabha election from the Haveri-Gadag Lok Sabha seat. However, the party denied him the ticket and gave it to former chief minister Basavaraj Bommai.

Eshwarappa expressed displeasure at his son’s failure to secure a ticket and blamed former chief minister BS Yediyurappa for this.

He later announced his candidacy for the Lok Sabha election from Shivamogga, aiming to free the party from the influence of Yediyurappa and his sons. Regarding the usage of photographs, in the previous Assembly election, Arun Puttil, who recently joined the BJP, used Modi’s photo when contesting as an independent candidate from the Puttur Assembly constituency.
