Karnataka High Court Warns Contractors on Slum Housing Projects

Bengaluru : The Karnataka High Court has upheld the decision of the Karnataka Slum Development Board (KSDB) to terminate a construction firm’s contract, following the firm’s appeal against the board’s refusal to extend the project timeline. Justice Nagaprasanna, leading the bench, delivered the ruling on January 23.

The dispute stemmed from the firm’s request for an extension, which was denied by the KSDB despite previous extensions granted in 2018 and 2020, totaling 654 days and one year, respectively. The board cited the firm’s inability to complete the work within the allotted timeframes as the basis for contract termination.

The firm’s legal representative contended that the KSDB’s delays in allocating construction sites hindered progress. They argued that allowing others to take over the project at current rates would significantly increase costs, burdening public funds.

However, the state counsel countered, highlighting the firm’s repeated failure to meet deadlines and the incomplete state of many houses designated for slum dwellers. They emphasized that some slum residents had even volunteered to assist with construction due to the delays.

The bench, after reviewing evidence, noted the inadequate progress made by the firm, with numerous houses remaining partially constructed or untouched. They emphasized that despite initial progress, the overall completion rate fell short of expectations.

Consequently, the petition was dismissed by the bench, which criticized the firm for its lack of commitment despite repeated opportunities. The court directed the KSDB to promptly reissue work orders and ensure the timely completion of housing projects for impoverished slum dwellers, prioritizing their welfare and safety.
